Cal Supreme Court denies Friends of Lagoon Valley petition

BENICIA, CA / November 14, 2007, 7:00 PM    On Wednesday, the California Supreme Court
denied the petition by Friends of Lagoon Valley for review of the Density Bonus section of their lawsuit. The petition sought to challenge an Appeals Court ruling that significantly weakened state law providing for Affordable Housing.

Friends of Lagoon Valley's website states, "That's the end of the road for this lawsuit, but we continue to pursue our environmental challenges to a Lagoon Valley subdivision through the U.S. Army Corps of Engineers. (see ACE Permit Application)"

Friends of Lagoon Valley (FLV) leads the fight against a subdivision development of Vacaville's last remaining semi-rural valley. The Developer (Triad Communities) plans to build over 1000 homes, a golf course and a business village on an 862-acre parcel on the south side of Interstate 80 between Fairfield and Vacaville in Solano County.

An extension of the Suisun Marsh and San Francisco Bay, Lagoon Valley is a unique watershed which impacts four creeks in the immediate area. Lagoon Valley is "a treasure trove of archaeological and historic resources, the gateway to our lovely city and a buffer from surrounding sprawl," according to Elissa DeCaro, a member of Friends of Lagoon Valley.
